These are Civil Litigations, so infact the Burden of Proof is shared Equally, and the Threashold is not "resonabvle doubt" but "beyond perpondrous of the Evidance" or "more likly than not"

Trust me it'll never happen. That is SO SO SO un-warranted evidence. Especially if the IP belongs to a DSL user who's IP changes.

Mikey just so you know.... the Burden of proof is always on the prosecution.... even in civil suits. Civil suits ALSO require more than "a more than likely" decision. Even if that's how Civil cases worked.... any good defense lawyer could win these cases.

There WILL never be any real proof that the defender had actually PERSONALLY downloaded these files. And that's what it would require..... 100%!

You can not prosecute an IP address....

the point, Never Say never, I have no Doubts that a judge would issue a Search warrant based soley on a IP, personally I dont think they would even need a IP, Judges are just a Crooked as the People Wanting the warrants

and your Wrong, the Burden of Proof in Civil Cases is FAR FAR FAR FAR lower than in Criminal Cases, and In Civil Cases you have to Prove your not Resposible, just as they have to Prove you are

 

hmm, i heard some talk about kazza lite earlier

i swear i read somewhere, CNN or MSNBC, that kazza lite was a clone program made by the RIAA to track kazza downloads :blink:

the RIAA does NOT track, or Record anything in reality, they use 4 differant Contractors to Collect the IP's

 

i could be wrong about the RIAA, but i swear there was something specific about kazza lite not actually being kazza
