Long story short, I was taken into the station for trying to get into a dance club with a fake id. I ended up getting 3 citations. 1) misrepresenting my age; specifically by presenting false identification 2) hindering by giving false information to a law enforcement officer specifically by giving officer flase identification 3) obstruction by purposely impairing the administration of law specifically by preventing officers from performing an official function I filed a police report because the assholes stole my diamond earring. One of the officers ripped it out of my ear while the other had me pinned to a wall with his forearm on my throat. Anyways, I was wondering what I should do and what kinda penalties I should expect
First thing is, if he tore your earring out that is brutality. While I am in no way condoning what you did, that is wrong, and I do suggest you file a report. Your record will really depend on your age (under 18 hopefully for your sake). If you are under 18, any and all misdemeanors will be sealed. I am not sure about trying to fool the cops (the last 2 charges), they may be a felony. I wonder if the hindering charge is obstruction though... Did you try to run away or fight back in any way? If that is the case they will laugh your earing complaint out the window, and likely that is a felony. My hope is that you simply gave them the wrong name, and that isn't too bad. Likely, and my assumption is this is your first brush with the law, you will wind up with some community service and some probation... Gotta love community service. They didn't come down hard on me untill my 5th arrest :blush: ... well, if you don't count the time the cops beat me and left me in the park :angry: . Funny thing is, that was likely the only time I was ever innocent.
my adivce Get a good Lawyer... I dont care if you have to work another job, or take out a loan GET A GOOOOOOOOOD lawyer why, it will come down to your word against the cops for the Brutality, if you can prove that, there is a good chance all charges relating to that can be dropped if you agree not to sue the city or in some cases even without the agreement, but that depends on the judge I believe in most area all 3 are very low misdemors if that, so even if you are over 18, 3 - 5 years you can have it sealed reguardless.. not that I would waste the time and money on something like that Drugs, or Theft or something yes, but I would not worry about these things being on your record
What about fines? Will I have to pay a shit load of money for this? This cops were dickheads and I defintely pissed them off because they wanted to fuck around with me and I was having non of it. The cops asked if it was a real id and I told them yes a couple of times until they said I had a last chance to confess and ofcourse I didnt because I know them and how they work. Confessing wont get you off the hook at all. They took me to the station and start telling me all this BS about being sent into county jail. You know, the stuff that is meant to spook you. So I got really pissed about that and refused to answer any of their questions. I told them they have all my info in the system and to look it up themselves. The cops start saying "oh we got a smart ass here. Probably a Poli-Sci major, he thinks he knows what the fuck he is doing..." A cop comes up to me and tells me to take off my hat and I do that. They talk all this bs about themselves and they tell me to take off my earing. I ask them what my earring has to do with anything and they tell me to shutup and take it off. I told them Im not taking it off until they tell me why. Of course they dont, so I tell them to let me see some documentation first. Well we go back and forth at that and they tell me that I now have to take off my shoes laces as well. At this point I got really annyed with them. So I get up and take my shorts down and ask them if there is anything else they want me to take off. At this point I still have my earing in. I get back up to button my shorts and the cop tells me to sit down. I tell him I will once I button my shorts. I get up and one cop rushes me and slams me into a corner. The other rips me earing off and pins my legs to take my shoes off. They then throw me into a cell but come back in 2 mins and take my glasses from me! I stayed in the cell till about 3 am and I was let out. The earing was never found. I know however that the cop had the diamond in his hand and he claims that I took it off. There is more to the story but that is the basic jist of it
well first your pretty much up the shit creek with out a paddle when you got up againt the officers orders, that can be construed as trying to escapse, thus Justfiying the Tackle.. Being "mouthly" with cops will get you know where, dont be coopertive, but dont mouth off either, That sadly comes with age... You have to learn to be KURT, with them.... Only providing infomation you have to legally, while still being Respectful, even if they are not... the only thngs you should have said 1> I am under arrest? if no, Ask to be Set free, they can not hold you with out arrest if yes, Then you are required to Remove your shoes and jewlery and part of processing, this is with any arrest, but you should have asked for a Inventory Voucher to be Presented to you, before complying with there Requests, that is also SOP. 2> I want a Lawyer once you say that, They more or less have to stop with the questions, they can ask but you can sit there and say nothing, or repeat the phrase over and over Being a Smart ass will get you no where Again Get a lawyer... Fees, Community Service, and Jail time are all In those Charges if it is a first offense I see about 20-40hrs community service, with Jail and Fee suspended (minus Court Cost of about $150) and probation for 1 yr... that is will a Guilty plea and a Good laywer with out BOTH, 1-3 years in jail, $10,000 Fines could be the pently

I got myself a lawyer for $500 dollars. He says that there is a very good chance the criminal charges will be dropped to some personal something shit, meaning no record. If all goes well I will just have to pay fines, and afterall money is all these dirtbags really want.
