In case you do not belong to ECA which requires you to register there to read this, here is my thread...

Well, might as well bring it out in the open since this is the last email he sent me:

"I see that you have dealt with PAYPAL, so this is our end of discussion, I
will NOT REFUND ANY OF UR MONEY OUT OF MY OWN POCKETS for the 1st sub or the
2nd sub at all becuz u have ****ed me off already for what you have done.
If you dont' get ur money back from PAYPAL, too bad and I'll no longer
answer any of ur emals so don't bother writing back."

This is after this ahole sells me this (from his post on 1/2/04:

"I got a new BRAHMA 15" Sub that has never been power and never installed. It's still in it's original wood crate. $365US SHIPPED. Shipping is about $45-$55 depending on location so I think this is a steal that I am doing it for $365US SHIPPED. Sub is 45 lbs alone. "

However, a few days earlier, on 12/25/04, in his reply to another thread he wrote this...

"I absolutely agree with Ding. I bought my Brahma 15 just 2 weeks ago, received it yesterday and threw it into a 1.8 Cubic feet box powered by a TRU T2.100. That baby POUNDS like HELL already with the gain only set 1/4 up. No bass boost and the SUB is MOVING A LOT too so I don't thinking breaking in is necessary at all."

He also advertised the same sub on Ebay using a new version of Brahma picture... once again, claiming it was brand new and with warranty and factory packaging...

What I got: an OLD version Brahma wrapped in bubble wrap and newspaper... stuffed in a carboard box so thin you could feel the bottom plate through it... Needless to say, it came completely destroyed with the basket completely cracked around the cone, pretty well scratched up and with no crate or sales receipts or warranty paper...

At the time I sent him the money to pay for this Brahma, he convinced me to send him money for another Brahma which according to him he would order for me, receive it within a week and then ship it to me... That was on the 5th of this month and paid through paypal...

Well, yesterday this POS arrived and it nearly made me speechless... I emailed him right away and he claimed he did not know anything about Brahma and did not know there was a newer version... This is in spite of having the picture of the new version on his Ebay auction. Also, he told me that the original crate broke so he took the special care to package the sub safely... LOL...

When asked to take this POS back and refund my money since he misrepresented the merchandise to begin with, his answer was he did not have the money and that the package was insured. Interestingly enough, the declared value on the package says 0. Nevertheless, he claimed he would file insurance claim since he did supposedly have the receipt of insurance that he bought AFTER shipping the sub. Ok, whatever... I would grow old waiting for the claim considering he did not even have a proof it was damaged since I have the frigging sub... This is if he really did have the insurance...

When I asked him about the other sub, when it would be shipped and if this was the right one, his reply was that he was pretty sure it was the new one, right...

I demanded my money back right away for the second sub since I did not want to deal with the same $hit all over again... However, he claimed he could not do that since he ALREADY ordered the sub (the sub he was suppose have on the 12th and ship it already to me..)

I asked him very nicely to refund the entire money and he gave me the same run around... I warned him I would take other measures and he still was giving the same $hit... He actually ignored my questions re. his post about using this sub and claimed it was brand new and it was the postal service fault that it was damaged, LOL... either stupid or lieying through his teeth... Most likely the second... Oh, since he ordered the second sub, it would take another 14-20 days to return it to refund my money....

Well you know what you mofo? enough of this... Since my bank has to suck it to paypal, I notified the paypal first since they like to go through the motions first (not like they gonna do anything but still they like to take a shot). I guess they did get in touch with him, LOL... So I guess al bets are off... I am pretty sure I will get my money back but in the meantime, I do not want anyone to get %ucked by this mofo so here it goes (to the best of my knowledge):

Yes, he has entered a legally binding contract with Pay-Pal if he can accept payment from them, he must ship the appropriate product. It is not your responsibility, Pay-Pal will probably ask for the subs, and then refund you the money, if he does not refund pay-pal, they will sue. If you payed $730? for them, then that is something Pay-Pal will take very seriously. Also, if it was on ebay, with the wrong picture, Pay-Pal will more than likely prosecute him with a sort of fraud

I always did like PayPal...

Makes me very skeptical when I see auctions stating "Will NOT accept PayPal!" in bold letters, like "I've had problems with them..."

As a buyer, makes you suspect the seller got caught with fraud in the past.

yea the people that run the "paypalsucks" sites or post on their are people like this guy that either directly scamming people, or have had problems with things like Shipping and dont feel it is their responsibly to refund since UPS screwed up

Like a while back a Guy on CAF was buidling a Box for someone, he Quouted XXXX price shipped, only to find out the box was Over UPS Girth limit and would cost more than the orginal Quote price, and refused to refund the money because he had XXX in materials and he also felt was was entitled to some compensation sicne he did build the box, so his time should be compensated even though the box was not shipped

It is your responsibility to refund your money if something went wrong...

...which you should get back in full from UPS, because you were forward-thinking enough to have insured it for the value of what it was worth.

In the end, UPS shouldn't be able to screw you, as a customer of theirs.

yes, also considering shipping insurance is usually only like $3, which seems more than worth it to me when it could mean possible replacing a deffective item that cost you hundreds......

well yes and no

I have never once Been Screwed over by UPS or Fedex, and I have filed Claims with both for differant intaceds, both of Damaged and Lost/Stolen Packages.......

The porblem lies with both UPS's and FEDEX shipping rules

if they inspect the package and deem that it was not packaged per thier published Packing Guidlines they are under no obligation to pay out....

Now sometime they will anyway, just like subwoofer warranty's and Blown coils, but it is "have to get the right claim person" thing

well, ok... paypal actually does suck big time IMO based on my extensive experience with them over years but they are improving somehow in some aspects. The bottom line is the guy gave in no time... I guess must have been a combination of Vancouver PD intervention, paypal assault, offers from a few people to personally pay him a visit (yeah, it is a small world after all) plus the fact that he still tries to sell stuff on ebay and forums... So he refunded me money for most of the first sub, I got the money right away back from paypal, lost a few but richer by experience, LOL...

He reversed the transaction on the second sub on the 21 of this month, however, paypal decided to suspend the transaction and gave it a pending status... Yes, it is still pending until today... Plus they charged me again for the transaction but just a few bucks. However, the transaction is still pending... I wrote them today asking WTF is happening but no reply yet... If something happened, I can still get my money back actually...

My credit union has a special service that allows me to invalidate any instant transfer, providing I can supply them with a valid reason... They would collect from this dude's bank regardless if he has any money there or not... then his bank would go after him... So I am actually covered, LOL... I guess there is always a way out... Just when things look they could not get worse, they get better...

BTW, do not think that paypal would refund you any money once the other person withdrew from their paypal account... they make sure to state they will only attempt to recover the funds but if the other party does not want to pay, you would be SOL...
